If you access or use the Sterling Auctions Services, it means you agree to be bound by all of the terms referenced below. Please read all of the terms. If you do not agree to all of the terms below, please do not use or discontinue the use of Sterling Auctions Services. Please carefully review the section entitled "Limitation of Liability" prior to accessing the Services.

Sterling Auctions may revise these Terms & Conditions at any time without notice by updating this posting. By use of the Sterling Auctions Services, you agree to be bound by any such revisions and should therefore periodically review these Terms & Conditions to determine the current Terms to which you are bound.

Subject to your compliance with these Terms & Conditions, we grant you a limited, revocable, non-exclusive, non-assignable, and non-sublicensable license to access content, information, and related materials that may be available through the Services.

You agree that you will not license, distribute, create derivative works from, display, sell, or "frame" any part of the Services. The Services and the rights herein are, and shall remain, the property of Sterling Auctions. Use of the Services does not convey or grant you any ownership rights other than the limited license granted above.

All copyrights, trademarks, design rights, patents, and other intellectual property rights (registered and unregistered) in and on the Services belong to Sterling Auctions and/or its partners or applicable third parties.

You are required to register for and maintain an active personal user services account ("Account") prior to using the Sterling Auctions Services and participating in online auctions.

You must be 18 years of age, or the age of legal majority in your jurisdiction. You may be required to submit certain Personal Data (as defined in Section 9) and, when applicable, an acceptable valid payment method.

You agree to maintain an accurate, complete, and up-to-date Account. Failure to do so may result in an inability to access or use the Services. You may not provide false information, create an account for anyone other than yourself, impersonate any person or entity, or otherwise mislead as to the origin of content.

You agree to maintain the security and secrecy of your Account username and password at all times. You are responsible for all activity on your Account and may not authorize third parties to use it.

You agree to comply with all applicable laws when using the Services and may only use the Services for lawful purposes.

Sterling Auctions Sales: "Buy Now" sales refer to items with a fixed sale price available for immediate purchase. Single or multiple items may be purchased at any time. Buyers located in Canada are subject to applicable taxes.

Sterling Auctions Auctions: Sterling Auctions offers regularly scheduled online auctions. Auction lots are available for viewing throughout the auction period. During this time, bidders may ask questions, request additional photographs, or submit inquiries to Sterling Auctions staff.

Auction Lots: Auction lots may include collectible items that some individuals may consider offensive due to their historical nature. If you find any auction lot offensive, please discontinue use of the website. It is not the intention of Sterling Auctions to cause offense.

Most lots offered are antique or historical items and therefore may not be in perfect condition. Descriptions may list defects or damage when known; however, not all flaws may be described. Photographs are provided as accurately as possible but may not reproduce exact colour.

All lots are sold as authentic. For the purpose of this sale, "authentic" means not faked or forged. Sterling Auctions will not knowingly sell any item that has been repaired, restored, processed, cleaned, pressed, or conserved without disclosure. If a lot is proven to be fake, a full refund will be provided once the item is returned in accordance with the Return Policy.

Auction Verification: In order to participate in auctions, bidders may be required to verify their account by providing identification or proof of address. Verification may take up to 72 hours.

Bidding Process: Once registered and verified, users may place bids on auction lots. Bidders are encouraged to enter the maximum amount they are willing to pay. The system will automatically place incremental bids to maintain the bidder's position as the highest bidder.

Bidding Terms: Placing a bid constitutes full acceptance of these Terms and Conditions. The highest bidder acknowledged by Sterling Auctions shall be the buyer. In the event of a dispute, Sterling Auctions reserves the right to determine the winning bidder or to re-offer the lot for sale.

Sterling Auctions reserves the right to reject bids, ban bidders, or refuse participation in auctions at its sole discretion. Users are responsible for securing their accounts and logging out after each session.

After the Hammer: When an auction ends, successful bidders will receive notification and instructions for completing checkout.

A Buyer's Premium equal to 24% of the successful hammer price will be added to the total balance owing and is payable by the buyer. The Buyer's Premium rate is non-negotiable.

Sales and Payments: All pricing is listed in United States Dollars (USD) and may be subject to applicable taxes. Payment must be made within 14 days of the auction closing unless otherwise agreed with Sterling Auctions.

Sterling Auctions reserves the right to void a sale if payment is not received within this timeframe.

Until payment has been completed, Sterling Auctions retains possession of all items.

Accepted payment methods include bank transfer, e-transfer, PayPal, cheque, bank draft, international money order, MasterCard, and Visa. PayPal may only be accepted for transactions below $1500 USD, including shipping and taxes, and availability may vary by country.

Failure to Collect: If a paid lot remains uncollected for six (6) months, Sterling Auctions reserves the right to relist the item. Proceeds may be forfeited if unclaimed within two (2) years.

Shipping: Shipping and handling costs are calculated based on destination, weight, size, and shipping method. These costs are presented during checkout. All efforts are made to ensure items are securely packaged. Import duties and associated charges remain the responsibility of the buyer.

Sterling Auctions assumes no liability for merchandise lost, stolen, or damaged during transit unless shipping insurance has been purchased.

Shipping Insurance: Shipping insurance is available at a rate of 2% of the order value (excluding shipping). Claims may require supporting documentation and photographs.

Return Policy: Items may be returned for a refund or merchandise credit if the following conditions are met:
1. Notification must be provided within 14 days of delivery.
2. Items must be returned in the same condition as received.
3. Cleaning, disassembly, or alteration voids the return policy.
4. The buyer is responsible for return shipping.

Refunds will be issued to the original method of payment only once the item has been received and inspected.

Sterling Auctions is not responsible for payment processor fees, service charges, or currency conversion differences.

If an item is determined to be non-authentic, Sterling Auctions will provide a full refund if returned within six (6) months of delivery.

Sterling Auctions makes no representations or warranties that the Services will be uninterrupted, secure, or free of defects or viruses.

In the event of technical issues affecting an auction, Sterling Auctions reserves the right to extend, restart, reopen, or void any auction.

You agree to hold Sterling Auctions harmless from claims arising from the use of the Services.

Under no circumstances shall Sterling Auctions be liable for lost profits, lost data, property damage, or any consequential damages resulting from use of the Services.

Liability will be limited to the maximum extent permitted under applicable law.

You agree to indemnify and hold harmless Sterling Auctions, its affiliates, employees, officers, and agents from any claims, damages, losses, or expenses arising from:
- your use of the Services,
- your violation of these Terms, or
- Sterling Auctions' use of information provided through your Account.

Your privacy is important to us. Sterling Auctions will make reasonable efforts to protect your data and account information.

Personal data collected may include name, contact details, payment information, and related account information necessary to provide Services.

By opting into shipping insurance, the buyer agrees to pay an additional 2% of the order value to cover potential loss or damage during transit. Insurance claims must be filed within 7 days of delivery and include appropriate documentation.

Processing and administrative fees cover the costs associated with order verification, packaging, shipping coordination, tracking, and customer service.

The Sterling Auctions Processing and Administration Fee is 4% of the total lot value.

These Terms shall be governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein.

Both parties agree to submit to the jurisdiction of the courts of Ontario.

Sterling Auctions reserves the right to terminate your access to the Services at any time, without notice, for any reason.

Sterling Auctions shall not be liable to you or any third party for termination of access.
